1. Agreement and eligibility
By creating an account or using CharterOsprey, you agree to these Terms. You must be authorized to act for the charter business and capable of entering a binding agreement.
2. The service
CharterOsprey provides software for booking, scheduling, payments, gift cards, communications, reporting, and charter operations. CharterOsprey is not the charter operator, vessel owner, payment processor, insurer, or employer of a captain’s crew.
3. Captain responsibilities
- Provide accurate business, vessel, trip, price, availability, safety, and contact information.
- Maintain required licenses, insurance, permits, vessel compliance, and customer terms.
- Protect account access, use appropriate staff roles, and notify us of suspected compromise.
- Honor applicable consumer, privacy, communications, refund, gift-card, tax, and maritime laws.
- Obtain consent before sending marketing or SMS messages.
4. Customer payments
Captains connect their own Stripe account for customer transactions. Stripe’s terms and fees apply. CharterOsprey records payment events but does not guarantee payment, prevent chargebacks, or take custody of charter proceeds. Captains control cancellations, refunds, taxes, gratuities, and gift-card obligations.
5. Subscription billing
CharterOsprey subscriptions are billed separately through Stripe Billing. After any trial, the selected plan renews monthly until canceled. Plan limits may restrict boats, trip types, or users. Fees are nonrefundable except where required by law or expressly stated otherwise.
6. Acceptable use
You may not abuse the service, probe or bypass security, access another tenant, upload unlawful or malicious material, misrepresent availability or pricing, send unlawful communications, or use the service in a way that harms others or our infrastructure.
7. Data and license
You retain rights in business and customer content you provide. You grant CharterOsprey the limited rights needed to host, process, back up, transmit, and display that content to provide the service. We retain rights in CharterOsprey software, design, documentation, and trademarks.
8. Availability and changes
We work to keep the service reliable but do not promise uninterrupted operation. Features may evolve. We may suspend access for security, legal, nonpayment, or material misuse reasons.
9. Disclaimers and liability
The service is provided “as is” to the extent permitted by law. Charter operators remain responsible for trip safety, weather decisions, customer service, regulatory compliance, and business outcomes. To the extent permitted by law, CharterOsprey is not liable for indirect, incidental, special, or consequential damages.
10. Ending service
You may cancel subject to your billing settings. We may terminate for material breach. After termination, access may end and data may be deleted after a reasonable export and retention period.
